CT 2.6 SALE OF GOODS- PERFORMANCE- INTRODUCTION

PERFORMANCE OF A CONTRACT FOR THE SALE OF GOODS.

Section 27 of the Sale of Goods Act provides that the seller must deliver conforming goods and the buyer is to accept and pay for them in accordance with the contract.

From the above, the essential elements of performance of a sale of goods contract entail:

  1. The delivery of goods by the seller.
  2. The acceptance of (conforming) goods by the buyer.
  3. Payment for the goods by the buyer.

In addition to these, it is submitted that the seller also owes the buyer an obligation to comply with all the implied terms provided in Sections 12-15 of the act.
